POLK COUNTY -- The Court has sentenced Jacob McPheeters on convictions for a 2019 Meth bust in Polk County that led to the seizure of 276 grams of methamphetamine.
McPheeters was arrested in November 2019 along with Samantha Leuthard during an investigation into a possible stolen vehicle McPheeters and Leuthard were stopped by law enforcement while traveling in a truck that was identified as stolen out of Minnesota.
Polk County K9 Jaeger assisted with the discovery of 65 grams of methamphetamine, several glass smoking devices which tested positive for methamphetamine residue, over 4 grams of marijuana, a large quantity of unused gem bags of the type used in packaging controlled substances, and a large quantity of cash. After the vehicle had been impounded, a second search at a later date led to the discovery and seizure of an additional 200+ grams of meth, bringing the total grams seized to 276.
McPheeters was charged with Class C Felony Possess w/Intent-Amphetamine (>50g), Class I Felony Drive or Operate Vehicle w/o Consent, Misdemeanor Possession of THC (Marijuana), and Misdemeanor Possess Drug Paraphernalia, Party to a Crime, and McPheeters also faces a penalty enhancer for being a repeat offender.
Charges of Class G Felony Theft-Movable Property >$10,000-$100,000 and Class H Felony Theft-Movable Property >$5000-$10,000 were also filed against McPheeters in a separate Polk County court case.
Online circuit court records show that McPheeters appeared most recently on August 1, 2022, for a sentencing hearing on a conviction of Class C Felony Possess w/Intent-Amphetamine (>50g), Party to a Crime. The repeater enhancer was dropped, and all other charges against McPheeters were dismissed but read-in.
The Hon. Jeffery Anderson ordered McPheeters to serve a 10-year sentence, with 5 years of initial confinement in state prison followed by 5 years of extended supervision. Conditions of supervision will require McPheeters to maintain absolute sobriety, complete an alcohol and other drug assessment and comply with recommendations, and also complete any other treatment or programming deemed necessary by his agent.
Online circuit court records show that Leuthard is scheduled to appear again in October 2022 for a 4-day jury trial regarding her criminal charges of Class C Felony Possess w/Intent-Amphetamine (>50g), Class I Felony Drive or Operate Vehicle w/o Consent, Misdemeanor Possession of THC (Marijuana), and Misdemeanor Possess Drug Paraphernalia, Party to a Crime.
Pursuant to the direction of the Wisconsin Supreme Court, as found in Supreme Court Rule 20:3.6, Trial Publicly, you are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.
